Caregivers

A primary caregiver is a person who consistently assumes the responsibility for the house, health, or safety of a patient.

A primary caregiver may not possess or maintain more than the state legal limit unless you have a waiver to grow more plants. For information on waiver to grow more plants click here.

You may transport, process, administer, cultivate, deliver or give away marijuana to patients who have designated you as their caregiver. In order to avoid criminal liability you must be eligible to be a primary caregiver.

You can receive compensation for actual expenses and services: out-of-pocket expenses and usual expenses for taking care of the patient. However, you may not cultivate and give out marijuana for a profit! You may be charged with possession for sale.

You may get a California Health Department I.D. card, but it is not a requirement to be a primary caregiver.
